Does anyone know if it's okay for me to upload a mod that I've converted to this website, if I don't have permission from the author? I'm only asking this question because I have tried and failed to contact and request permission (he didn't say no, he just didn't reply at all) from the author of a mod (poison spells, which is found here for oblivion http://www.tesnexus.com/downloads/file.php?id=6668). I've actually already converted it, and it works fine for me, but I'm not sure whether or not I'm allowed to upload someone else's mod even WITH their permission. There don't seems tot be any rules to uploading mods on this website (that I've found). I'm pretty sure that the author (flyfightflea) wouldn't mind, I'm not going to be taking any credit for myself, and of course I would take it down if he contacted me and told me to do so. But without a working way to contact the author, and since I had no hand in actually making the mod, I'm not sure what the guidelines are.
If your going to upload to nexus, then just give him editing right when you upload then no one can complain and doubt they will, and as youve said your not trying to take credit.
It's always good to contact the person and ask for permission. You are most likely to get them without trouble, on the other hand, if you don't ask, you may get a very bad awakening when the person in question displays their disapproval of your actions. People don't do this to make it hard on modders, they just want to be precisely informed about what happens with their work.

How long did you wait for permissions? Not all people can answer your questions right away, so giving them two weeks is considered a norm. If you don't get an answer even then, it's best to state this fact in the description loud and clear. All the other things you have considered are right too, if you don't want to take credit for someone elses work, then no one should blame you.
In answer to your questions, I tried to message him the only way I knew how, using the Nexus forums messenger. I messaged him on the 1st of October, so if 2 weeks is the norm, then I'll just wait till the 15th. I also didn't know you could give editing rights, but I will definitely do so when I upload. Thanks, I didn't want to do something by accident that would be rude, or seen as stealing.
A bit of friendly advice...in these situations ALWAYS also check the readme included in the file download. It often contains different or additional information. I happened to check this file...the author has a yahoo email address included for contact.

I would pop a message off, however since no action has been on this file since 2007 I doubt you will have many issues.
